facio.social is a social media, professional networking and career development platform that has been designed and built exclusively for the creative community. This Privacy Notice has been written to inform you about how Facio Creative, the owner and operator of facio.social, collects and uses your personal data when you use or access the platform.

 

It is important for you to know that under EU Regulation 2016/679, more commonly known as the General Data Protection Regulation (if you are based within the European Economic Area) or the Data Protection Act 2018 (if you are based within the United Kingdom), and similar regulations in other states, countries and territories, you have certain data rights relating to the information and personal data we collect from you. This includes knowing about the data we hold, how we process that data, and the purposes for which we use your data.

 

As the owner and operator of facio.social, Facio Creative is the data controller. As the data controller, it is our responsibility to maintain this notice, manage your data, and ensure that all data we hold, process and use is done so in accordance with all relevant legislation and regulations.

 

This Privacy Notice will outline your data, rights, how you are able to exercise those rights, and how you can verify the details of any personal information we hold on you (if any). This notice also outlines how you can request that information is updated or deleted.

 

You should read this Privacy Notice alongside our Terms of Service, Eligibility Rules, platform rules and any other terms, conditions, rules or places we publish in relation to such use, and any additional terms or rules we may publish from time to time in relation to any specific feature or benefit available throughout the facio.social platform.

 

By accessing any part of the facio.social platform, any associated features, services or benefits that we provide to you through the platform, or any account you create, use and/or manage on the platform, you are deemed to have signalled your understanding of, acceptance of, and agreement to this Privacy Notice, our Terms of Service, Eligibility Rules, platform rules and any other terms, conditions, rules or places we publish in relation to such use, and any additional terms or rules we may publish from time to time in relation to any specific feature or benefit available throughout the facio.social platform.

 

Residents of the State of California are granted additional privacy rights under the California Consumer Privacy Act (CCPA). California Civil Code Section 1798.120 provides residents of the State of California “Do Not Sell My Personal Information” rights. Details of these rights, how they affect you, and how you can exercise your right to opt-out are included at the end of this Privacy Notice.

The creative network — facio.social is a social media, professional networking and career development platform that has been designed and built exclusively for the creative community.

 

facio.social is owned and operated by Facio Creative. Facio Creative is the trading name of Facio Creative Limited, a limited liability company registered in England and Wales with company number 15426208. Our registered office is 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.

If you have any questions or enquiries relating to this Privacy Notice, or how your personal data is collected, processed or used, or if you wish to exercise any of your legal data rights, you can contact Facio Creative by emailing hello@facio.social.

 

If you are contacting us about something that is related to your account, please ensure you email us from the email address that is registered to your account, and ensure that you include your username within your email. In some instances, we may be required to further verify your identity before we are able to help you.

 

You can also contact Facio Creative by going to facio.social/contact and completing the web form. If you have an account on the platform, please ensure you are logged in to be given additional contact options.

3   The information we collect from you

The exact information or personal data we collect from you varies depending on the sort of relationship and interactions we have with you, and the way in which you use the facio.social platform and the features offered through it.

 

We collect information and personal data from you through five channels:

 

When accessing the platform

 

Whenever you access any part of the facio.social platform, whether as a member of facio.social or otherwise, we collect information and personal data that discloses to us the way in which you have accessed the platform, including your device, operating system and browser, and whether you have accessed the platform directly or via a link on a third party website or communication. We also collect information relating to how you use the facio.social platform, such as the pages you have visited and how long you spent on each page.

 

When becoming a member

 

When you become a facio.social member by creating an account on the platform, you are required to provide us with certain information and personal data, including your legal name, date of birth, pronouns and country of residence.

 

To maintain the integrity and security of the platform, all facio.social members are required to verify their account after becoming a member. To do this, you are required to provide us with a government issued identification (such as a driving license or passport). We use this identification solely for the purpose of identifying your identity, and do not store your identification beyond this.

 

When using the platform

 

Whenever you use the facio.social platform, we collect information and personal data from you, including personal data that you voluntarily add to your profiles, or that is contained within content that you choose to upload and add to the platform.

 

The exact information and personal data we collect in this way will depend on the data that you voluntarily provide or add to the platform, but will typically be information relating to your professional career and may include special categories of data (see below).

 

When you interact with us

 

Whenever you interact with us, we collect information and personal data as part of that interaction. The exact information and personal data we collect in this way will depend on the way you interact with us and the reason for the interaction, but will typically include your basic contact information, details of the reason you are contacting us, and any other information you voluntarily provide to us (including in response to any request we make for further information).

 

When provided by third parties

 

Whether you are a facio.social member or not, we may collect information and personal data about you from third parties. In some cases, this may be from third parties who we work with, partner with, or contract services from, in order to provide you with continued use of the facio.social platform and the benefits of your facio.social members.

 

Often, we may also collect information and personal data about you whenever a third party posts or otherwise adds content or data to the facio.social platform, or when another user, such as a casting director, agent or potential employer, uses the features we offer.

 

The information and personal data we collect from third parties will vary depending on who the third party is and their relationship to us. However, the personal data collected will be similar to the personal data we collect through other channels.

4   Special categories of data

In some situations, the information and personal data we collect from you may be defined by the General Data Protection Regulation and Data Protection Act 2018 as a special category of data.

 

Such information includes, but is not limited to:

 

  • Your status as a member of a trade union or other similar trade body, including the name of that trade union or trade body.

  • Your ethnic background and religious views.

  • Your sexual orientation.

  • Information relating to your physical or mental health, including any disabilities or access requirements you have.

  • Other information relating to a protection characteristic, as defined by the Equality Act 2010 (within the United Kingdom) and other similar legislation in other states, countries and territories.

 

While Facio Creative will always work to protect your information and personal data, special categories of data will typically only be collected for the purpose of hosting your professional profile and résumé, allowing you to search and apply for jobs, castings and other opportunities, and ensuring your profile appears in filtered searches by other members and users of the facio.social platform (such as casting directors, agents and potential employers). In these circumstances, special categories of data will be collected and shared on your specific instruction, and such data may be displayed publicly on your professional profile and résumé, or otherwise made available to other members and users of the facio.social platform.

 

You are always able to update or delete information or personal data which is considered a special category of data from your account and profiles, or otherwise turn off sections of your professional profile and résumé which contain such data. However, you should be aware that such information and personal data may already have been archived or saved outside of our control, including but not limited to, by internet archiving services, screen captures made by other members and users of the facio.social platform, downloading or recording by casting directors, agents and potential employers, or where you have provided such data through the platform’s messaging or application features.

 

Special categories of data contained within content

 

Occasionally, we may unintentionally collect special categories of data from you when you post or add content to the facio.social platform. In these instances, the special categories of data we collect may include information in addition to the examples listed above, such as your political views.

 

When special categories of data are collected in this way, the data will be held on our systems for the purpose of hosting your content, but will not be used for any other purpose. You should be aware, however, that the semi-public nature of content hosted by the platform means such data could be collected or used by third parties outside the control of Facio Creative, including, but not limited to, by internet archiving services, screen captures made by other users of the platform, and downloads by other users of the platforms.

 

You are always able to delete information which is considered a special category of data contained within content you have added to the platform. However, as set out in this Privacy Notice, you should be aware that this will not immediately delete such data from our systems. You should also be aware that such information may already have been collected, archived and saved outside the control of Facio Creative, including, but not limited to, by internet archiving services, screen captures made by other users of the platform, and downloads by other users of the platforms.

 

Special categories of data provided by third parties

 

In some cases, special categories of data relating to you may be collected when provided to Facio Creative through the platform by a third party. This includes, but is not limited to, when a third party posts or adds content to the platform, or when another user, such as a producer, casting director, agent or potential employer, uses one of the platform’s features.

 

In these circumstances, it is the responsibility of the third party who provides the special category of data to ensure they have your advance consent, or a valid exemption from obtaining consent (i.e. members of the press reporting public information), before allowing us to collect special categories of data.

 

While the social and semi-public nature of the platform means Facio Creative is unable to check and approve all content posted or added to the platform prior to its publication, we are committed to ensuring your personal data and privacy are protected. We will remove any content you report to us as containing a special category of data, where we are able to verify this case, and the user posting the content does not have your advance consent or a valid exemption.

5   Why and how we collect your data

Facio Creative collects your information and personal data for the purpose of carrying out our legitimate business interests, activities and operations. These include, but are not limited to: 

 

  • Providing you with membership of facio.social.

  • Providing you with access to the facio.social platform and the features available through it.

  • Hosting your professional profile.

  • Allowing you to search for and interact with job and casting opportunities.

  • Allowing you to communicate and network with other facio.social members and users of the platform.

  • Hosting content you voluntarily add to the platform.

  • Verifying your identity or the information you have added to your profile.

  • Providing you with any associated features and services available as a benefit of your facio.social membership.

  • Processing any payments you make for your membership and use of the facio.social platform, or any associated features and services.

  • Carrying out any obligations we have to you under any contract or agreement we have with you, or any business relationship that we may enter into you with you.

 

Information and personal data collected when you have an account

 

In most circumstances, Facio Creative collects information and personal data from you when you create an account on facio.social and use that account to interact with the platform. This includes, but is not limited to, when you update your social profile, update your professional profile, post and add content to the platform, or otherwise initiate an interaction with us through the platform, such as when you report a concern about another user’s profile (including, but not limited to, misleading information, inaccurate credits, and copyright infringement), report a concern about content another user has added to the platform (including, but not limited to, misleading information, spam, harassment, copyright infringement, or other breaches of the platform’s rules of Terms of Service), or when you make a payment for using the platform.

 

On occasion, we may also collect information and personal data from you through channels off the platform, such as when you choose to contact Facio Creative by email or through another social network.

 

Information and personal data collected when you don’t have an account

 

Except for limited analytic and statistical data (where your cookie settings allow), if you don’t have an account on the facio.social platform, we typically only collect information and personal data from you when you initiate an interaction with Facio Creative either through the platform, or by email or through another social network.

 

Information and personal data collected from third parties

 

Whether you have an account on the platform or not, Facio Creative may collect information and personal data about you from third parties. In some cases, this may be from third parties we work with, partner with, or contract services from to provide you with continued use of the platform.

 

Often, we may collect information and personal data from you when a third party posts or adds content to the platform, or when another user, such as a producer, casting director, agent or potential employer, uses one of the platform’s features.

 

In these circumstances, it is the responsibility of the third party who provides the information and personal data to ensure they have your advance consent, or a valid exemption from obtaining consent (i.e. members of the press reporting public information), before allowing us to collect the information and personal data.

6   Using and sharing your data

While Facio Creative is committed to following leading data protection practices, it is important to remember that the nature of the facio.social platform means our primary purpose is to share the information and personal data we collect from you with other users and third parties.

 

Selling your data and sharing information without your consent

 

Facio Creative does not sell any information or personal data we collect from you, and we do not share any information or personal data without your prior consent (including where consent is implied), except where obligated to do so under law and/or by regulation, or as set out in this Privacy Notice.

 

Sharing data and information with your consent

 

By accessing any part of the facio.social platform, any associated features, services or benefits that we provide to you through the platform, or any account you create, use and/or manage on the platform, you are deemed to have signalled your understanding of, acceptance of, and agreement to provide Facio Creative with implied consent to collect, store, use, and share your information and personal data as set out in this Privacy Notice, and where applicable, based on your individual account settings. 

 

While using the platform

 

Facio Creative relies on your implied consent to collect, store, use, and share your information and personal data in the following, non-exclusive, ways:

 

  • To host your social and professional profiles, and any content you add to the platform.

  • To make your social and professional profiles, and any content you add to the platform, viewable by other users of the platform, and in certain circumstances, third parties who do not have their own account on the platform.

  • To allow you to interact and communicate with other users of the platform, both in a social and professional capacity.

  • To allow you to submit an application or expression of interest to calls for collaborators, job postings, opportunity notifications, and casting calls which are added to the platform by other users.

 

To provide you with use of the platform

 

Facio Creative relies on your implied consent to collect, store, use, and share your information and personal data in the following, non-exclusive, ways:

 

  • Where we are required to use your information and personal data, or share such information and personal data with third parties, in order to carry out any contract we have with you, or to provide you with continued use of the platform. This includes, but is not limited to, sharing your information and personal data with, and storing such information and personal data on servers owned by, our web and database hosting providers, and any third parties we may work with, partner with, or contract services from, in order to provide you with continued use of the platform.

  • Where we undergo a change of control or if any of our assets are sold and/or transferred to a third party. In this circumstance, we may transfer your information and personal data to that third party in order for them to continue providing you with continued use of the platform without disruption, subject to the continued provision of data protection practices that match or exceed those outlined in this Privacy Notice.

  • Where we are required to share your information and personal data in order to comply with a legal obligation or lawful order from a court or judge whose jurisdiction we are under, or where we have a lawful basis for doing so for the purpose of fraud and crime prevention.

 

Technical errors

 

On rare occasions, technical errors (including those caused by your own device and browser, such as loading pages through an outdated device or slow internet connection) may result in some dynamic content (i.e. your social profile, professional profile, and any content you have added to the platform) displaying incorrectly. This may include sections of your professional profile that are set not to display appearing when navigating to your profile. Facio Creative therefore reminds you to only add information and personal data to your profiles if you are comfortable with this information being publicly viewable, even where you have not enabled your professional profile or have sections of your profile turned off.

 

Third parties

 

While Facio Creative will only ever share your information and personal data as set out in this Privacy Notice, you should be aware that we are unable to control or stop third parties (i.e. other users of the platform) collecting and collating any data you voluntarily make available on the platform, and sharing this data without your consent or knowledge.

7   Transfers of data outside the U.K. and EEA

If you are based within the United Kingdom or EEA, the multi-national nature of the facio.social platform and Facio Creative’s operations mean that any information, personal data or content you add to the platform will be transferred outside of and available to access outside of these jurisdictions. This includes, but is not limited to, your social and professional profiles, and any content you have added to the facio.social platform is viewable to other facio.social members and platform users who are accessing the platform outside of these territories.

 

Access to the facio.social platform is blocked for devices located outside the countries and territories we offer membership within. While in theory this means that any information, personal data or content you add to the platform is inaccessible outside of these locations, the potential use of virtual private networks (VPNs) from within blocked countries and territories means this cannot be guaranteed.

 

In limited circumstances, information, personal data and content may be transferred to countries and territories whose own laws and data protection regulations may not be recognised by the EU Commission as providing an adequate level of regulatory protection. In these instances, such information and personal data will only ever be accessed through secured and verified connections, and best practice will always be followed to ensure the protection of your personal data.

 

In situations where Facio Creative's employees or agents are working remotely or from a location outside of the United Kingdom or EEA, information, personal data and content may be accessed and processed by these authorised individuals outside of these locations. In these instances, such information and personal data will only ever be accessed through secured and verified connections, and best practice will always be followed to ensure the protection of your personal data.

8   Under eighteens

You must be aged sixteen or over to become a facio.social member and create an account on the facio.social platform, or otherwise access and/or make use of the platform and any services and features we offer through it. If you are aged sixteen or over but under eighteen, you can only become a facio.social member with the consent and knowledge of a legal parent or guardian.

 

Facio Creative does not intentionally collect any information or personal data from any individual who is aged under sixteen, or from any individual who is aged sixteen or over but under eighteen, and who does not have the consent of a legal parent or guardian to provide us with their personal data. If we discover any information or personal data has been collected under such circumstances, we will permanently delete the relevant information and personal data as soon as possible, unless we are required to retain the data in order to comply with any legal or regulatory obligations we may have, or where it relates to any crime or potential crime that is being or has been carried out.

 

If you are a legal parent or guardian who has become a facio.social member and created an account on the facio.social platform on behalf of an individual who is aged under sixteen, we rely on your implied consent to collect and process the personal data of that individual in accordance with this Privacy Notice. Once the individual has reached the age of sixteen, you should contact Facio Creative by emailing hello@facio.social to begin the process of transferring ownership of the account to that individual.

 

If you became a facio.social member and created an account on the facio.social platform while aged sixteen or over but under eighteen, you warrant that a legal parent or guardian consents to you becoming a member and using the facio.social platform, and we rely on this implied consent to collect and process your personal data. Upon reaching eighteen, we assume your own continued implied consent to continue collecting and processing your personal data in line with this Privacy Notice. If you wish to withdraw your consent, you can contact Facio Creative by emailing hello@facio.social to begin the process of suspending your membership and permanently closing your facio.social account.

9   How we store your data

Any information and personal data we collect from you, along with any content you add to the facio.social platform, is stored primarily online using secure servers and databases, with occasional storage offline on secure devices. Information, personal data and content may be stored on servers which belong to third party service providers (including those we use to host the facio.social platform, associated services, and process any payments you make). Facio Creative only uses third party service providers whose own data protection practices offer a level of protection which is equal to our own.

 

Facio Creative retains and stores informational, personal data and content only for as long as is necessary for us to provide you with continued use and access to the facio.social platform, continued use and access to your facio.social membership and account on the facio.social platform, access to any associated services, features or benefits, to fulfil any outstanding contract, obligation or legal relationship we have with you, to fulfil the purpose of which we collected the information or personal data, to fulfil our legitimate interests, such as preventing fraud, crime and misuse of the platform, and to fulfil or comply with any legal and/or regulatory obligations you may have.

 

In practice, this means we store information, personal data and content until you either update or delete the data from your account. 

 

Data relating to content you have added to the platform, and other information, such as professional credits and media, is stored indefinitely on our servers, but is not visible or accessible to you or any other facio.social member or user of the platform once you have deleted the content. We may permanently delete any such information, personal data and content at any time after you have deleted it from your account.

 

You should be aware that information and personal data may still exist within secure backups of the platform’s systems, servers and databases, even after it has been deleted from our primary servers, and will continue to do so until such backups are deleted or overwritten. In rare circumstances, if we are required to utilise one of these backups due to a failure of our primary servers or corruption to our databases, deleted information, personal data and content may reappear on your account.

 

It is important for you to know that the platform’s messaging and application (for casting notices, jobs and opportunities) do not operate with encryption. Any messages and content sent using these systems are viewable and retrievable by Facio Creative, even if otherwise deleted from your account. Facio Creative does not routinely access or monitor messages sent between users, or the contents of any application made through the platform. However, you should be aware that we will review any messages (including earlier messages within a thread) which are reported to us by another user, or if we suspect that you may be using the facio.social platform for an unlawful purpose. Where necessary, we may also provide copies of your messages to law enforcement or any other agency that has made a lawful request.

 

If we suspend your account for breaching the platforms rules or Terms of Service (including any other terms, rules or policies that we publish in relation to your use of the platform, any associated features or services that we provide to you, and any account which you create and/or manage on the platform), or if we deny your request to become a facio.social member and create an account on the facio.social platform, we will retain certain information and personal data, including your name, email address, and the reason we have suspended your account or denied your request. This information is stored securely and indefinitely for our own legitimate purposes. In the event your account is suspended, other information and personal data on your account will be treated similarly to if you had requested we permanently close your account. 

 

Facio Creative has a legitimate interest in securing your information and personal data, and is committed to doing so. While we take all required and appropriate measures to secure your information and personal data in accordance with best practice, we ask you to note that no method of data storage or transfer can be guaranteed as fully secure, and so we ask you to take simple measures in order to secure any information and personal data you provide to us.

 

Security implications exist when disclosing information and personal data online and through email, which Facio Creative cannot be held responsible for. This includes, but is not limited to, where there are security vulnerabilities in your own connection or on the devices you use to access the facio.social platform.

 

For security reasons, we ask you to carefully consider the information and persona data you choose to add to your account and your profiles on the platform, as well as the content you choose to upload. We also ask that if we request you provide information through a specific process, system or channel in order to protect your data, that you respect and comply with this request. 

10   Your data rights

Under the General Data Protection Regulation, the Data Protection Act 2018, and similar legislation in other countries and territories, you have a number of rights relating to the information and personal data Facio Creative collects from you. In general, these rights are:

 

  • To obtain a copy of the information and personal data we hold on you.

  • To request we correct any information and personal data we hold on you, where that information or personal data is not accurate or has become out of date.

  • To request, in certain circumstances, that we remove from our databases and servers any information and personal data we hold on you, where it is no longer necessary for us to retain such information and personal data.

  • To withdraw your consent to the processing of your information and personal data if we are relying on your consent to process such information and personal data.

  • To request, in certain circumstances, that we transmit the information and personal data we hold on you elsewhere (known as “data portability”).

  • To object to us processing your information and personal data. If you do this, we will stop processing your information and personal data where we are doing so for our own legitimate interests, unless we can demonstrate legal grounds for the continued processing of your information and personal data, or where the processing of your information and personal data is necessary for the performance of activities in the public interest.

  • To ask that we restrict the processing of your information and personal data, where you contest the accuracy of such information. If you do this, we will stop processing your information and personal data until we have verified the accuracy of the information and personal data we hold, or where we no longer need to retain or process the relevant information and personal data.

  • To be given an explanation about any automated decision-making and profiling that produces a legal or otherwise significant effect on you.

Where Facio Creative isn't the data controller

 

You should be aware that the nature of the facio.social platform means that there will be circumstances in which we hold and store your information and personal data, but are not the data controller. This will typically occur when a third party adds information or content to the platform that contains your information and personal data (such as a producer providing your personal data when using one of the platform’s features).

 

Facio Creative is only able to respond to data requests relating to data for which we are the data controller. This means that if you submit a data access request to Facio Creative, we will be unable to provide any information or personal data held on our systems, servers and databases unless we are the relevant data controller. In this circumstance, you must contact the relevant data controller directly if you wish to make a request or exercise any of your data rights.

11   Deleting data and deactivating your account

In most cases, you can delete data and content from your profile and account directly within the platform. You should be aware, however, that for the purpose of security and crime prevention, and to maintain the integrity of the platform, deleting content from your profile will not immediately delete it from our databases or servers.

 

Facio Creative will typically permanently delete data and content from our databases and servers within six months of you deleting it from your account. However, this period may be extended where we have a legitimate basis for doing so, including, but not limited to, where we believe the content you have posted on the platform is unlawful, to investigate whether you have listed illegitimate credits on your professional profile, or where we are assisting with a lawful investigation or request from a third party (e.g. law enforcement).

 

If you wish to permanently deactivate your account, you can begin the process from within your account settings. Once your account has been deactivated, it will remain open for 30 days. After this time, your account will be permanently closed. We will typically permanently delete all data and content from your account within six months of your account being closed. However, this period may be extended where we have a legitimate basis for doing so, including, but not limited to, where we believe the content you have posted on the platform is unlawful, to investigate whether you have listed illegitimate credits on your professional profile, or where we are assisting with a lawful investigation or request from a third party (e.g. law enforcement).

 

Once your account has been closed, you will be eligible to create a new account (subject to meeting our eligibility criteria), but any data from your old account will be permanently lost.

 

You should be aware that data and deleted content may still exist within secure backups of the platform’s databases and systems, even after it has been removed from our primary services, and will continue to do so until such backups are deleted or overwritten. In the rare event we are required to restore our databases and servers from the platform’s backups, recently deleted data and content may unintentionally be resorted to your account.

12   Third party links and services

The nature of the facio.social platform and the features and services provided by Facio Creative through the platform mean you will often come across links to third party websites, services and communications. In most situations, these links will be provided within content and information that has been added to the platform by other facio.social members and platform users.

 

You are reminded that if you click on any third party link, or request a service, purchase a product from, to interact with any third party on or through the facio.social platform, or any associated feature or service provided by Facio Creative through the platform, our Privacy Notice does not apply, and you do so at your own risk.

 

Any interactions or relationship you have with a third party is subject to that party’s own privacy practices and published privacy notices, the protections of which may not be of an adequate level or equal to our own. Facio Creative does not endorse, control or monitor the privacy practices and published privacy notices of platform users, and we encourage you to always become familiar with such practices and notices before initiating any interaction with another user, or providing another user with your information and personal data.

 

This Privacy Notice applies only to your interactions and relationship with Facio Creative and your use of the facio.social platform. 13   Interactions with other users

You should be aware that whenever you interact with other users of the platform, you may be providing those users with your information and personal data. This includes, but is not limited to, when you send another user a message, comment on another user’s post, or when you interact with, respond to, or submit an application to a job or casting notice.

 

You are reminded that when you provide information and personal data to other users of the platform, including through features provided as part of the platform, our Privacy Notice does not govern how that user handles your information and personal data, and that you do so at your own risk. 

 

Facio Creative does not endorse, control or monitor the privacy practices and published privacy notices of platform users, and we encourage you to always become familiar with such practices and notices before initiating any interaction with another user, or providing another user with your information and personal data.

 

If you have any concerns about the way another user (including casting directors, agents, producers and organisations) is handing you information and personal data, you can report these concerns to us by emailing hello@facio.social. Where necessary, we will take action to limit a user’s use of the platform or suspend their account. You may also have the right to report your concerns to the relevant National Data Protection Authority.

14   Email notifications, contact and marketing

Except to provide you with essential updates and information (i.e. major changes to the platform or our policies, the launch of new platform features, notifications relating to your account, to carry out additional verification checks on your account and the content you have added to the platform, or to help you reset your password), Facio Creative will not contact you by email. 

 

Facio Creative does not currently send marketing communications. 

 

The platform does not currently send you an email notification to inform you of a new notification on your account, including when another user likes or comments on one of your posts, or sends you a new message.

 

If you have contacted us for any reason, we may contact you by email in order to respond to your query, concern or complaint, or to provide you with technical support.

 

In some circumstances, you may receive emails from third parties we work with, partner with, or contract services from in order to provide you with continued use of the platform. This includes, but is not limited to, payment processors providing with you payment receipts.

15   Complaints

If you have any concerns or complaints regarding any aspect of our Privacy Notice or our data protection practices, including those relating to the way Facio Creative has collected and processed your personal data or responded to any privacy complaint you have made to us, you may have the right to report your concerns and complaints to the United Kingdom’s Information Commissioner’s Office (ICO).

 

Details of how to make a complaint can be found on the ICO website at ico.org.uk, or by phoning +44 (0) 303 123 1113. If you are located outside the United Kingdom, you should instead call +44 (0) 1625 545 700.

 

In some instances, the ICO may require you to contact Facio Creative with your concerns or complaint directly, before they are able to examine your case. To do this, you can contact Facio Creative by emailing hello@facio.social.

 

If you are located outside the United Kingdom, you may also have the right to submit your concerns or complaints to your own country or territory’s National Data Protection Authority.

16   Changes to our Privacy Notice

From time to time, it may be necessary for Facio Creative to make changes to this Privacy Notice for business, legal or regulatory reasons. Whenever we make significant changes to this Notice, we will endeavour to provide advance notice of the changes we are making and what these mean for you, including by email if you have created an account on the platform. However, such advance notice may not always be possible, and so we therefore recommend that you periodically review our Privacy Notice in order to be informed of any changes we make to it.

17   California Consumer Privacy Act

Residents of the State of California are granted additional privacy rights under the California Consumer Privacy Act (CCPA). California Civil Code Section 1798.120 provides residents of the State of California “Do Not Sell My Personal Information” rights.

Where voluntarily added to your social profile or professional profile, or contained within content that is voluntarily added to the platform, we may disclose your preferred name, your professional name (where different), and other identifying information. We additionally collect your legal name and date of birth for our own internal records and to provide you access to our platform. For the purpose of verifying your identity, we may also request you provide a copy of a government-issued ID, such as a driving license or passport, that contains further personal identifiers.

 

Protected classifications under California or federal law

 

Where voluntarily added to your social profile or professional profile, or contained within content that is voluntarily added to the platform, we may disclose information relating to your ethnic background and religious views, sexual orientation, status as a member of a trade union or trade body, nationality, and your physical and mental health, including any disabilities or access requirements you have.

 

Customer records

 

Where voluntarily added to your social profile or professional profile, or contained within content that is voluntarily added to the platform, we may disclose information relating to your physical characteristics, or that relate to your skills as a performer and/or creative.

 

We may additionally collect further information, such a your signature and financial payment details, when you instigate certain interactions with Facio Creative, the platform, any associated services or features we offer to you, or with any third party we work with, partner with, or contract services from, in order to provide you with continued use of the platform.

 

Commercial information

 

Where voluntarily added to your social profile or professional profile, or contained within content that is voluntarily added to the platform, we may disclose information relating to your commercial interests, such as whether you are a member of a trade body or association, and any projects, companies or organisations you are involved with.

 

We may request additional information from you for the purpose of carrying out legitimate verification and due diligence checks, before allowing you access to certain features offered through the platform.

 

Biometric data

 

We only collect biometric data where such data exists in any documentation or identification you provide to us for the purpose of carrying out legitimate verification and due diligence checks, before allowing you access to certain features offered through the platform. Biometric data is never stored once verification or applicable checks have been carried out, and we never disclose such data.

 

Geolocation data

 

Where voluntarily added to your social profile or professional profile, or contained within content that is voluntarily added to the platform, we may disclose information relating to your location.

 

Based on your cookie settings, we also collect data relating to your county, location with that country, and your IP address for our own legitimate purposes, including analytics analysis and fraud and crime prevention.

 

Professional information

 

Where voluntarily added to your social profile or professional profile, or contained within content that is voluntarily added to the platform, we may disclose information relating to your employment and professional history.

 

We may additionally collect professional information relating to you from third parties (such as agents, casting professionals or employers) as set out in this Privacy Notice.

 

Internet activity data

 

We disclose certain data relating to your use of the platform, such as whether you have seen a message and how you have interaction with a post. When you view another user’s post or their professional profile, we also anonymously record your view.

 

We may additionally collect internet activity data that discloses to us the way in which you have accessed the platform, including the device, operating system and browser you have used, and whether you have accessed the platform directly or via a link on a third party website or communication.

 

Sensory data

 

Where voluntarily added to your social profile or professional profile, or contained within content that is voluntarily added to the platform, we may disclose sensory data, including media files you have uploaded to the platform.

 

We may additionally collect sensory data relating to you from third parties (such as agents, casting professionals or employers) as set out in this Privacy Notice.

 

Educational information

 

Where voluntarily added to your social profile or professional profile, or contained within content that is voluntarily added to the platform, we may disclose information relating to your education history and any training you have undertaken.

PERSONAL INFORMATION ACCESS AND DELETION REQUESTS

 

Under the California Consumer Privacy Act, you may have the right to request information about how we collect personal data from you and the data we collect, a copy of the personal data we hold on you, and that we delete your personal data. If you are contacting us about something that is related to your account, please ensure you email us from the email address that is registered to your account, and ensure that you include your username within your email. In some instances, we may be required to further verify your identity before we are able to help you.

“DO NOT SELL MY PERSONAL INFORMATION”

 

As of the publication of this Privacy Notice, Facio Creative has not sold the personal of any individual (“consumer”) as defined under the California Consumer Privacy Act. Facio Creative has no intention to begin selling any personal information within the next 12 months.

 

Any resident of California who still wishes to exercise their “do not sell my personal information” data rights can do so by emailing hello@facio.social.

 

You should be aware that Facio Creative is unable to control or stop third parties (i.e. other users of the platform) collecting and collating any data you voluntarily make available on the platform, and selling this data without your consent or knowledge.

 

THE RIGHT NOT TO BE DISCRIMINATED AGAINST

 

Facio Creative does not discriminate against any individual for exercising their rights under the California Consumer Privacy Act.

 

REPORTING OF DATA REQUESTS

 

Access requests

 

As of the publication of this Privacy Notice, Facio Creative has not received any request under the California Consumer Privacy Act from a resident of the State of California requesting access to their personal data.

 

We are required to disclose aggregate numbers of these requests on an annual basis.

18   Residents of Nevada

Residents of the State of Nevada have the right to opt out of the sale of certain personal information collected and processed by Facio Creative.

 

Facio Creative does not currently sell any information covered by regulation, as “sale” is defined by law, and as of the publication of this notice, we have no intention to begin selling such covered information.

 

You should be aware that Facio Creative is unable to control or stop third parties (i.e. other users of the platform) collecting and collating any data you voluntarily make available on the platform, and selling this data without your consent or knowledge.

19   Residents of Washington

Residents of the State of Washington should be aware that in some circumstances, information and personal data that Facio Creative collects from you may be defined as “consumer health data” under the My Health My Data Act (MHMDA) of Washington State.

 

Data we collect which may fall within the scope of the MHMDA includes data outlined in Section 3 and Section 4 of this Privacy Notice. Facio Creative may use consumer health data as outlined in Section 6 of this Privacy Notice.
